Tyngsborough Planning Board Approves Kendall Road Restaurant, Advances ADU Rules
TYNGSBOROUGH — March 19, 2026 — Tyngsborough Planning Board unanimously approved a special permit for a new restaurant and tavern on Kendall Road while debating ADU bylaw language ahead of an April 2 public hearing. The board cleared applicants Francis and Sam Glavin to build a 3,505-square-foot addition with a 1,660-square-foot patio at 16-20-0 Kendall Road, subject to ADA accessibility conditions including an accessible route from the right-of-way to the building entrance, an updated lighting plan, and architectural drawing review. Board member John Murphy's proposed ADU amendments — including a short-term rental prohibition and a 900-square-foot size cap with a "50 percent of principal dwelling" floor — drew broad support, though three provisions remain under town counsel review. Members raised pointed concern that new ADU units counted as separate dwellings could erode the town's roughly 10.5 percent affordability index, potentially triggering renewed Chapter 40B exposure, and asked staff to put the question to town counsel Adam Costa before the April 2 hearing.
