Waltham Board Continues Furr Avenue Road Petition, Sends Package to Law Department
WALTHAM — April 1, 2026 — Waltham's Board of Survey and Planning unanimously continued a petition to repair and repave Furr Avenue, a private way, pending legal and engineering review. Attorney Philip B. McCourt Jr. represented developer Ed Beaton, who seeks to build two single-family homes on Lots 513 and 515 and needs road improvements for access. Attorney Michael O'Neill of McGregor Law Group, representing abutters at 11 Furr Avenue, cited the derelict fee statute, GL 183 section 58, arguing residents own to the centerline of the way and can contest the project. Civil engineer Robert Gemma's report, commissioned by abutters, identified missing contour maps, no road centerline profile, and an inadequate stormwater system. Resident Sue Hildreth warned of 110-decibel impact hammering within 25 feet of homes and the loss of five off-street parking spaces. The board directed all four opposition documents — three letters and the Gemma engineering report — to the city's law and engineering departments before the hearing resumes.
