Littleton Board of Health Continues King Street Hearing, Cites Deed Restriction Requirement
LITTLETON — April 8, 2026 — Littleton's Board of Health continued a public hearing on a third-floor renovation at 100 King Street, conditioning final approval on updated drawings and a deed restriction tied to the property's four-bedroom septic system. Chair Kevin Davis and members Dan Kane and Kevin Baker voted 3-0 to continue the hearing after a detailed Title 5 room-count analysis revealed that finishing the attic-level walk-up space would push the home's habitable room total to ten, one above the threshold allowable without a restriction, given a septic permit issued in 2004 for a four-bedroom dwelling. Contractor Sean Keenan argued the rooms have existed since the 1800s, but staff documented a 2007 sale listing that described the third floor as "walk-up third floor expansion potential," supporting the board's position that the space was not historically counted as habitable. The board also voted 3-0 to advance draft tobacco regulations to a public hearing without waiting for outstanding guidance from Leominster, and received an update that a regional substance use specialist position — shared among six towns and housed in Littleton — has an RFP out with a July 1 target start date.
